("Eclectic," "we," "us," or "our") operates the website at https://www.shopeclecticco.com (the "Site") along with our physical retail collectives in Downtown Colorado Springs, Old Colorado City, and Circa Vintage. We care about your privacy and want you to understand what information we collect, why we collect it, how we use it, and the choices you have.

This Privacy Policy applies to information we collect through the Site, our email newsletter, our contact and application forms, in-store transactions, and any other interactions you have with us. By using the Site or providing us with information, you agree to the practices described here.

We collect information you voluntarily give us when you:

  • Fill out our Contact Us form (name, email address, phone number, and any message content)

  • Apply to become a vendor or apply for our Gallery Wall program (name, contact information, business details, portfolio links, and any materials you submit)

  • Purchase a gift card or make another purchase through the Site (billing name, billing address, shipping address if applicable, payment card information, and order details)

  • Create an account (name, email address, password, and any profile information you choose to provide)

  • Inquire about shipping a product via email or social media (the content of your message and any contact details you share)

  • Visit us in store (payment information at checkout, and optional contact details if you join our email list)

Information Collected Automatically

When you visit the Site, certain information is collected automatically by our hosting platform and analytics providers. This includes:

  • IP address and approximate geographic location

  • Referring URL and pages visited on the Site

Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC, to collect aggregated information about Site usage. Google Analytics uses cookies and similar technologies to gather data such as pages visited, time spent on pages, referral sources, approximate geographic location (derived from IP address), device and browser characteristics, and interactions with Site content. We may enable Google Analytics features that support advertising measurement and audience insights.

Google processes this information to generate reports for us about Site activity. Google may also use the data collected through Google Analytics in accordance with its own privacy practices.

Microsoft Clarity

We use Microsoft Clarity, a behavioral analytics service provided by Microsoft Corporation, to capture how visitors interact with the Site. Microsoft Clarity records session replays, heatmaps, click patterns, scroll depth, mouse movement, and other engagement signals. It also collects technical data such as IP address, browser type, device type, referring URLs, and approximate location.

The information collected through Microsoft Clarity helps us identify usability issues, understand which features are most valuable, and improve the browsing experience. Clarity masks certain sensitive inputs by default, but you should assume that any information you type into a form field or interact with on a page may be captured as part of a session recording unless that field has been specifically masked.

Microsoft uses the data collected by Clarity in accordance with its own privacy practices and its agreement with us.

Squarespace

The Site is hosted on Squarespace, which provides its own set of analytics, security, and infrastructure tools. Squarespace collects information on our behalf as our service provider and in accordance with its privacy policy at https://www.squarespace.com/privacy.

Payment Processors

Online purchases (such as gift cards) are processed by third-party payment providers integrated with Squarespace Commerce. We do not store your full payment card number on our servers. Payment card information is handled directly by our payment processor subject to Payment Card Industry Data Security Standards (PCI DSS). In-store purchases are processed through our point-of-sale payment provider, which handles card data under the same PCI DSS framework.

How We Use Your Information

We use the information described above for the following purposes:

  • To operate the Site and our retail businesses, including processing transactions and fulfilling orders or shipping requests.

  • To respond to contact form messages, application submissions, and shipping inquiries.

  • To review and evaluate vendor and Gallery Wall applications.

  • To send newsletters, promotional messages, event announcements, and vendor updates when you have subscribed. Every marketing email includes an unsubscribe link.

  • To maintain your account and any preferences associated with it.

  • To analyze Site performance, troubleshoot technical issues, and improve design, content, and product offerings.

  • To detect, investigate, and prevent fraud, abuse, security incidents, and violations of our terms.

  • To comply with legal obligations, respond to lawful requests, and enforce our agreements.

  • To communicate important administrative information, such as changes to this Privacy Policy or our terms.

We do not sell your personal information for monetary payment. We do engage in certain cross-context behavioral advertising and analytics activities that, depending on where you live, may be treated as a "sale" or "sharing" under applicable privacy laws.   • Service providers and processors. We share information with vendors who help us operate our business, including Squarespace (hosting and commerce), Google (analytics), Microsoft (behavioral analytics), payment processors, email service providers, shipping carriers, and point-of-sale technology providers. These parties are authorized to use your information only as necessary to provide services to us.

  • Professional advisors. We may disclose information to our accountants, attorneys, insurers, and similar professional advisors as reasonably necessary.

  • Legal compliance and protection. We may disclose information when we believe in good faith that disclosure is required to comply with a legal obligation, respond to lawful requests from public authorities, protect our rights or property, protect the safety of our customers or the public, or investigate fraud or security issues.

  • Business transfers. If Eclectic CO. is involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to standard confidentiality obligations.

  • With your consent or at your direction. We may share information for other purposes with your consent.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Criteria we use to determine retention periods include the nature and sensitivity of the information, the purposes for which we process it, applicable legal and tax obligations, and whether the information is needed to resolve disputes or enforce agreements.

When information is no longer needed, we either delete it, anonymize it, or securely store and isolate it from further use.

California Residents

If you are a California resident, you have rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act (collectively, "CCPA"), including the rights to know, access, correct, delete, and opt out of the sale or sharing of personal information, as well as limit the use of sensitive personal information. We will not discriminate against you for exercising these rights. California residents may also designate an authorized agent to make requests on their behalf.

Other Jurisdictions

Residents of other states or countries may have similar rights under applicable law. We will respond to verified requests consistent with those laws.

How to Exercise Your Rights

Please describe the request clearly and include enough information for us to verify your identity. We typically respond within the time period required by applicable law, generally 45 days.

Opting Out of Marketing Email

You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any message we send, or by emailing us to request removal from our mailing list. We may still send you non-promotional messages such as transactional or account-related communications.

Children's Privacy

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe that a child under 13 has provided us with personal information, please contact us so we can delete it.
